PAYMENT TERMS

To confirm a booking, a non-refundable deposit is required together with proof of payment. The deposit amount and remaining balance are specified in the approved quotation on a per-client basis. All payments must be settled in full in accordance with the agreed payment plan prior to the release of any images or video content and must be supported by proof of payment.

All payments are non-refundable except where services are not rendered, in which case any refund shall be limited to amounts paid less costs already incurred.

CANCELLATION AND REFUNDS

In the event of cancellation by the client, all payments made shall be forfeited as liquidated damages, except where services are not rendered, in which case any refund shall be limited to amounts paid less costs incurred. Failure to comply with the agreed payment schedule will result in cancellation of services.

CONTRACT HIERARCHY

In the event of any inconsistency between this agreement and any quotation, invoice, or written communication, the approved quotation and invoice shall prevail, followed by these General Contract Terms and Conditions.

Where an independent quotation or contract is issued for album orders, such documentation shall prevail for album-related terms.

SESSION PREPARATION AND SCHEDULE

Clients must ensure adequate working space and suitable conditions for setup. Session time begins upon completion of setup. Majlis Manara Creative Space W.L.L. is not liable for compromised quality or results caused by inadequate space, overcrowding, restricted movement, or environmental limitations.

Session timing is based on the duration agreed in the contract and is not adjusted for client delays or late starts. Any delay caused by the client, guests, venue, or third parties will not reduce or shift the agreed session end time.

Any request to amend the agreed start time or schedule must be communicated in writing no less than twenty-four (24) hours in advance and is subject to availability. Requests made within twenty-four (24) hours of the scheduled start time may not be accommodated, and the originally agreed schedule shall remain in effect.

Majlis Manara Creative Space W.L.L. is not obligated to delay, extend, or reschedule services to accommodate client delays, particularly where subsequent bookings or prior commitments exist. Where an extension is requested and availability permits, such extension shall be treated as additional coverage and charged in accordance with the agreed rates.

The client acknowledges that cooperation of all parties involved is essential to achieving optimal results.

DELAYS AND ACCESS RESTRICTIONS

Majlis Manara Creative Space W.L.L. is not responsible for reduced coverage or compromised results due to restricted access, venue limitations, third-party interference, or schedule deviations beyond its control. Session time will not be extended to compensate for such circumstances.

TRAVEL EXPENSES

Travel expenses are waived for standard locations within Bahrain. Additional travel charges apply to the following destinations and all locations outside Bahrain, with fees determined based on location and job requirements:

• Durrat Al Bahrain and surrounding areas

• Jumeirah Gulf of Bahrain and surrounding areas

• All standalone islands surrounding Bahrain

ADDITIONAL COVERAGE

Additional coverage is charged on an hourly basis, unless otherwise specified on the approved quotation, calculated from the commencement of the next full session hour at the rate specified in the approved package. Requests for additional coverage during the session are subject to availability and cannot be guaranteed. Where availability permits, the client may be required to sign an additional coverage agreement on site prior to continuation of services.

LIGHTING REQUIREMENTS

Clients must disclose shoot-location lighting conditions at least forty-eight (48) hours prior to the event and ensure that suitable electrical outlet points are available within a reasonable distance for photographic equipment. Lighting preparation is based solely on the information provided, and Majlis Manara Creative Space W.L.L. is not required to supply additional lighting beyond the disclosed conditions or to rearrange, unplug, or interfere with venue electrical setups.

Majlis Manara Creative Space W.L.L. is not liable for compromised quality resulting from inadequate, undisclosed, or venue-controlled lighting or power access. Any lighting provided is for photographic purposes only.

LIGHTING CONTROL, GUEST INTERFERENCE, AND SPONTANEOUS MOMENTS

Majlis Manara Creative Space W.L.L. plans lighting based on agreed locations, timelines, and event flow. Image quality depends on subjects remaining within designated lighting areas and reasonable control of the shooting environment. The photographer shall not be held liable for variations in lighting quality or visual consistency caused by guest interference with lighting equipment, guests obstructing lighting, subjects moving outside designated lighting areas, crowd congestion or spontaneous event flow that prevents optimal positioning despite reasonable direction, or where lighting placement, distance, or proximity is restricted at the request of the client, venue, or event coordinator to preserve décor or venue aesthetics.

While reasonable efforts will be made to guide subjects and capture meaningful moments, the photographer is not required to interrupt the event, physically reposition guests, or enforce compliance in a manner that disrupts the atmosphere. The client acknowledges that prioritising spontaneity and uninterrupted celebration may result in images that are candid and documentary in nature rather than uniformly lit or posed.

REQUESTED PHOTOGRAPHS AND GUEST COVERAGE

Majlis Manara Creative Space W.L.L. will make reasonable efforts to provide comprehensive coverage; however, the capture of any specific individual, guest, grouping, or moment is not guaranteed unless expressly requested and reasonably achievable within event conditions and timelines.

Clients are responsible for identifying priority photographs. Where the photographer confirms during the event that no further photographs are required, Majlis Manara Creative Space W.L.L. shall not be liable for the absence of images of individuals or groupings not identified at that time. Verbal confirmations provided by the client during the event shall be deemed final.

Missed photographs due to guest unavailability, crowd congestion, schedule changes, or spontaneous event flow shall not constitute a breach of contract.

POST-PRODUCTION AND TIMELY DELIVERY

The initial gallery (photo and/or video) may be made accessible within a minimum of one (1) week and a maximum of one (1) month for standard sessions, and up to six (6) months for weddings and corporate projects. Raw, unedited photography and videography files will not be shared with the client under any circumstances.

Final deliverables, including edited galleries, albums, prints, videos, and slideshows, will be delivered within a maximum of three (3) months following the client’s final approval of edits and settlement of all outstanding payments. Majlis Manara Creative Space W.L.L. reserves the right to withhold delivery of all files and products until full payment is received and confirmed.

Any products not finalized within one (1) year of the event date will be deemed void and must be reordered, subject to additional processing fees.

No specific image, moment, or outcome is guaranteed beyond the scope expressly agreed in writing.

IMAGE SELECTION AND EDITING OPTIONS

Clients are offered the following two (2) image delivery options:

Majlis Manara Creative Space W.L.L. will select and deliver a curated gallery of the strongest highlight images at the photographer’s sole artistic discretion. This selection reflects the photographer’s professional judgment, and differences in personal preference or opinion regarding image selection shall not constitute a breach of contract.

The number of images delivered is determined by the nature of the event, the flow of moments captured, and the photographer’s professional assessment of quality and narrative cohesion, rather than by a fixed image count. Images are fully edited in a fine art retouching style. Requests for additional images or swaps will incur a fee equal to twenty-five percent (25%) of the total photography fee as invoiced, payable prior to release.

Option 2 – Full Gallery with Standard Editing

Images are delivered with minimal, standard editing only (basic colour correction and exposure). Advanced retouching, object removal, facial or body retouching, major cropping, or fine art edits are not included.

Following delivery of the password-protected gallery, edit requests must be submitted simultaneously via a favourites folder. Edit turnaround may take between one (1) and four (4) weeks depending on seasonal demand, unless otherwise communicated in writing due to unforeseen circumstances. Editable image quantity is determined by the approved quotation and invoice.

Majlis Manara Creative Space W.L.L. retains full artistic control over the final output. Exact replication of any editing style is not guaranteed. Image quantity varies based on event flow, duration, and circumstances.

ALBUM-BASED EDITING AND EDIT SCOPE

For any shoot resulting in a confirmed album order, only images selected for inclusion in the approved album layout will receive full fine art retouching once the layout is confirmed. All other images are delivered with standard editing unless otherwise specified. An independent quotation and contract will be issued for album orders and shall govern album-related terms.

For corporate assignments, editing scope and image quantities are governed by the applicable contract or statement of work.

Additional edited images beyond the agreed scope are charged between BHD 3 and BHD 15 per image depending on complexity. An additional edits quotation will be issued and must be paid in full prior to editing.

VIDEOGRAPHY OUTSOURCING

Videography services may be outsourced to reputable third-party providers. Artistic style and final outcomes are subject to the outsourced provider’s practices. Majlis Manara Creative Space W.L.L. coordinates delivery but is not responsible for stylistic preferences or creative differences.

ARTISTIC RIGHTS

Majlis Manara Creative Space W.L.L. retains full artistic discretion. Artistic style is subjective, and dissatisfaction with style does not constitute grounds for liability.

All photographs and video content remain the intellectual property of Majlis Manara Creative Space W.L.L. The client is granted a non-exclusive, non-transferable license for personal or agreed commercial use. Images may not be altered, edited, filtered, sold, sublicensed, or transferred without prior written consent.

Majlis Manara Creative Space W.L.L. may use images for portfolio, website, social media, and promotional purposes unless a written opt-out is requested prior to confirmation.

DATA ARCHIVING AND STORAGE

Raw, unedited files are retained for three (3) months following delivery. After this period, Majlis Manara Creative Space W.L.L. has no obligation to retain files unless extended storage is agreed in writing.

PRIVACY

Client data is stored within secure CRM, gallery, and accounting systems and may be accessed by accountants and auditors for regulatory purposes. Absolute confidentiality cannot be guaranteed when using online systems.

CLIENT RESPONSIBILITIES AND PERMISSIONS

The client is responsible for securing all necessary permissions, permits, and access approvals required for photography and videography at the event location.

EQUIPMENT FAILURE AND BACKUP

Reasonable measures are taken to maintain professional equipment and backups. In the unlikely event of equipment failure or data loss beyond reasonable control, liability is limited in accordance with this agreement.

SAFETY AND RIGHT TO WITHDRAW

Majlis Manara Creative Space W.L.L. reserves the right to suspend or terminate services if conditions become unsafe or hostile. No refund shall be due for services rendered.

FORCE MAJEURE

Majlis Manara Creative Space W.L.L. shall not be liable for failure or delay due to events beyond reasonable control. Services may be rescheduled subject to availability. Refunds, if any, are limited to amounts paid less costs incurred.

LIMITATION OF LIABILITY

Total liability for any claim arising from services is limited to the total fees paid. Majlis Manara Creative Space W.L.L. is not liable for indirect, consequential, emotional, or reputational damages.

GOVERNING LAW AND JURISDICTION

This agreement is governed by the laws of the Kingdom of Bahrain. All disputes fall under the exclusive jurisdiction of the courts of the Kingdom of Bahrain.

THIS CONTRACT IS TO BE SIGNED ON THE QUOTATION SPECIFIC TO EACH CLIENT SESSION
